Current Case Status

As of October 2, 2024, LeFever Mattson, Inc. (“LeFever Mattson”) and affiliated entities have filed voluntary petitions for relief under Chapter 11 of Title 11 of the United States Code (the Bankruptcy Code) in the United States Bankruptcy Court for the Northern District of California.  All proceedings have been consolidated for procedural purposes to be administered jointly under the lead case, In re LeFever Mattson, a California corporation, et al., Lead Case No. 24-10545 (Bankr. As of November 22, 2024, involuntary bankruptcy petitions have been filed against Kenneth W. Mattson (“Mattson”) and KS Mattson Partners, LP (“KS Mattson Partners”), for relief under Chapter 11 of the Bankruptcy Code in the Bankruptcy Court, in the cases titled In re Kenneth W. Mattson, Case No. 24-10714 (Bankr. N.D. Cal.), and In re KS Mattson Partners, LP, Case No. 24-10715 (Bankr. N.D. Cal.).  As a result, an automatic stay is currently in effect as to claims against Mattson and KS Mattson Partners.  This means that claims in the class action against Mattson and KS Mattson Partners are stayed (i.e., paused, but not dismissed) during the pendency of the bankruptcy proceedings against them. On March 3, 2025, the Bankruptcy Court denied Mattson’s and KS Mattson Partners’ motions to dismiss the involuntary bankruptcy proceedings. Discovery has commenced in thoes cases, and a further status conference has been scheduled for June 2, 2025, at 11:00 a.m. (Pacific).

On December 2, 2024, in light of the pending involuntary bankruptcies against Mattson and KS Mattson Partners, the Court entered an order staying the class action at the request of the remaining parties, Plaintiffs, Defendant Timothy J. LeFever, and Defendant Specialty Property Partners, LP.  Pursuant to their agreement, the parties filed a Joint Status Report on April 1, 2025, a copy of which can be found here.

The Official Committee of Unsecured Creditors (the “Committee”) for the LeFever Mattson bankruptcy proceedings is hosting its fourth virtual Town Hall on April 2, 2025 at 6:00 p.m. (Pacific Time). The purpose of this town hall is (i) for Bradley Sharp of Development Specialists, Inc. (the Debtors’ Chief Restructuring Officer) to share preliminary findings from the forensic analysis, (ii) for PwC US Business Advisory LLP (the Committee’s proposed financial advisor) to provide an overview of its analysis to-date of the proofs of interest and proofs of claim, and (iii) for Greg Gotthardt of FTI Consulting, Inc.
