Bankruptcy Case Status
Update (Sept. 30, 2025): On August 28, 2025, the Court entered an order, setting a deadline of October 3, 2025, at 11:59 pm Pacific Time to file a proof of claim against KS Mattson Partners, LP. Investors who want to assert a claim against KS Mattson Partners must complete and file a proof of claim by October 3, 2025. In addition, creditors (including those who believed they were investors in KS Mattson Partners or related entities) have the opportunity to complete and submit a voluntary creditor questionnaire. On September 15, 2025, the professionals for KS Mattson Partners and the Committee held a town hall which walked through how to complete the voluntary questionnaire and electronically submit a proof of claim. Since the Sixth Town Hall, the Committee has received several questions about: (i) how to complete the hard copy version of the proof of claim form, (ii) what to do if one’s files are too large to upload through the online claim portal, and (iii) when does one need a PIN / ID to submit their proof of claim and how to request one. Class Action Status
As of October 2, 2024, LeFever Mattson, Inc. (“LeFever Mattson”) and affiliated entities have filed voluntary petitions for relief under Chapter 11 of Title 11 of the United States Code (the Bankruptcy Code) in the United States Bankruptcy Court for the Northern District of California. All proceedings have been consolidated for procedural purposes to be administered jointly under the lead case, In re LeFever Mattson, a California corporation, et al., Lead Case No. 24-10545 (Bankr. As of November 22, 2024, involuntary bankruptcy petitions have been filed against Kenneth W. Mattson (“Mattson”) and KS Mattson Partners, LP (“KS Mattson Partners”), for relief under Chapter 11 of the Bankruptcy Code in the Bankruptcy Court, in the cases titled In re Kenneth W. Mattson, Case No. 24-10714 (Bankr. N.D. Cal.), and In re KS Mattson Partners, LP, Case No. 24-10715 (Bankr. N.D. Cal.). As of July 10, 2025, Mattson and KS Mattson Partners have agreed to orders granting the involuntary petitions and to proceeding voluntarily under the Bankruptcy Code. As a result, an automatic stay remains in effect as to claims against Mattson and KS Mattson Partners. This means that claims in the class action against Mattson and KS Mattson Partners are stayed (i.e., paused, but not dismissed) during the pendency of the bankruptcy proceedings against them. As of July 29, 2025 the Bankruptcy Court consolidated the Mattson and KS Mattson Partners bankruptcy proceedings with the LeFever Mattson bankruptcy proceedings.
On December 2, 2024, in light of the pending bankruptcies involving Mattson and KS Mattson Partners, the Court entered an order staying the class action at the request of the remaining parties, Plaintiffs, Defendant Timothy J. LeFever, and Defendant Specialty Property Partners, LP. Pursuant to their agreement, the parties have filed Joint Status Reports on April 1, 2025 and August 1, 2025.
The Official Committee of Unsecured Creditors (the “Committee”) for the LeFever Mattson bankruptcy proceedings has held virtual Town Halls for investors and plans to hold additional Town Halls in the coming months.
